General Terms and Conditions of Sale and Delivery

Article 1 – Applicability

1.1 These general terms and conditions apply to all orders, deliveries, and agreements related to laboratory tests offered via the website of World Health Laboratory.

1.2 By placing an order, the customer declares to have read and agreed to these terms and conditions.

1.3 Deviations from these terms and conditions are only valid if agreed upon in writing.

Article 2 – Services and Products

2.1 World Health Laboratory offers medical laboratory tests that customers can order via the website.

2.2 The tests are conducted in accordance with applicable quality standards and guidelines.

2.3 Test results are provided exclusively to the customer via a secure digital platform.

Article 3 – Ordering and Payment

3.1 Orders can only be placed through the website.

3.2 The customer is required to provide complete and accurate information when placing an order.

3.3 Payment must be made in full at the time of ordering via the available payment methods.

3.4 World Health Laboratory reserves the right to refuse or cancel an order if there is suspicion of misuse or fraud.

Article 4 – Delivery and Collection of Test Materials

4.1 Upon receipt of payment, the test materials will be shipped to the address provided by the customer.

4.2 The customer is responsible for the correct and timely collection and return of the test materials in accordance with the provided instructions.

4.3 World Health Laboratory is not liable for delays caused by external courier services.

Article 5 – Processing and Results

5.1 Laboratory analysis is conducted once the test materials have been correctly received and processed.

5.2 The results will be made available within the timeframe specified on the website.

5.3 World Health Laboratory guarantees the reliability of the test results but cannot be held liable for errors in interpretation or medical decisions based on the results.

Article 6 – Withdrawal and Cancellation

6.1 Due to the medical nature of the services, withdrawal is not possible after the test materials have been shipped.

6.2 Cancellation of an order is only possible if the test materials have not yet been shipped.

6.3 In case of cancellation before shipment, the paid amount will be refunded within 14 days.

Article 7 – Liability

7.1 World Health Laboratory is not liable for damages resulting from incorrect use of the test materials by the customer.

7.2 The laboratory is not responsible for interpretations or medical advice based on the test results.

7.3 Limited liability applies in the case of proven negligence by World Health Laboratory, with a maximum liability equal to the amount paid by the customer for the respective test.

Article 8 – Privacy and Data Protection

8.1 All personal data and test results are handled confidentially in accordance with applicable privacy laws.

8.2 Data will only be used for the execution of laboratory services and will not be shared with third parties without the customer’s consent.

Article 9 – Force Majeure

9.1 In cases of force majeure (such as pandemics, strikes, natural disasters, or technical failures), World Health Laboratory may temporarily suspend or cancel its obligations without being liable for compensation.

Article 10 – Applicable Law and Disputes

10.1 All agreements and disputes are governed by Dutch law.

10.2 Disputes will preferably be resolved through mutual consultation and, if necessary, submitted to the competent court.
